COUNTY BOARD MINUTES MAY 8, 2017 The Board convened on Monday, May 8, 2017 at 8:30 AM in the Courtroom located on 3rd Floor of the Courthouse with the following members present: Geerts, Tilkes, Carolan, and Hackman. Absent: Zoll. The meeting was called to order by Vice-Chairman Geerts. Mail was opened and distributed. Motion by Tilkes, Seconded by Carolan to approve agenda for May 8, 2017. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. Deputy Assessor Ray Armel met with the Board to discuss the process and procedures for properties lying near the intersection of 120th Street and Odessa Avenue. Also present were County Engineer Dusten Rolando, Assistant County Attorney Mark Huegel, Land Use Administrator Staci Schutte, Herod-Reicks Surveying (HRS) representative Kirk Reicks, Abstractor Zach Ruroden, and Auditor’s Clerk Patti Rosauer. Deputy Assessor Ray Armel presented the Board with the need for an Auditor’s Plat for properties lying near the intersection of 120th Street and Odessa Avenue. Actual deeded descriptions do not match actual occupancy due to the road locations. Discussion centered on Iowa Code 354 and the process that would need to be taken. Deputy Assessor Ray Armel, Assistant County Attorney Mark Huegel, Herold-Reicks Surveying, and Abstractor Zach Ruroden will work together on the process. The Board provided for the consensus that this work needs to be completed for the benefits of all parties, private and public. Further discussion and possible decision to be made at the next Board meeting. It is the consensus of the Board to proceed with the process for Jerico Right of Way intersection. The Board reconvened in the Board Room of the Courthouse at 9:00AM Motion by Hackman, Seconded by Tilkes to approve Board Minutes for May 1, 2017. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. Motion by Hackman, Seconded by Tilkes to rescind the motion dated May 1, 2017 as follows: Motion by Hackman, Seconded by Tilkes to sign a lease agreement with the Landlord (Growmark, Inc.) to rent the Law & Emergency Management Center (LEMC) building in the amount of $700.00 per month effective May 1, 2017 to December 31, 2018 and authorize Chairman Signature. Roll Call: All Ayes. Motion Carried. Motion by Hackman, Seconded by Tilkes to sign a lease agreement with the Landlord (Growmark, Inc.) to rent the Law & Emergency Management Center (LEMC) building in the amount of $700.00 per month effective June 1, 2017 to December 31, 2018 due to the recommendation of the County Attorney and authorize Chairman Signature. Roll Call: Ayes: Hackman, Tilkes, Carolan, and Geerts. Absent: Zoll. Motion Carried. Motion by Hackman, Seconded by Tilkes to acknowledge the hiring of Lisa Welter as Public Health and Home Care Services Assistant Administrator effective April 17, 2017 at the salary of $52,000. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. Received and place on file in the Auditor’s Office North Iowa Juvenile Detention Services Commission Financial & Audit Report ending June 30, 2016. Motion by Hackman, Seconded by Tilkes to approve Chickasaw County Firefighters Association Liquor License. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. Assistant County Attorney Mark Huegel and Northeast Iowa Community Action representative David Boss met with the Board to review and discuss the 28E agreement for General Assistance. Also present was a member from the media. Motion by Hackman, Seconded by Tilkes to enter into a 28E agreement with Northeast Iowa Community Action Corporation for General Relief Services effective July 1, 2017. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. Motion by Hackman, Seconded by Carolan to appoint David Boss as the General Relief Director effective July 1, 2017. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. Motion by Tilkes, Seconded by Hackman to enter into Chickasaw County Business Associate Agreement with Northeast Iowa Community Action Corporation effective July 1, 2017. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. The Board received four (4) sealed bids to repair the concrete in the parking lot at the jail building. Also present were Custodian Dave Gorman, Assistant County Engineer John Murray, Matt Construction representative Megan Matt, and a member from the media. Vice Chairman Geerts opened the sealed bids. Bids received from Brian Tank Masonry in the amount of $6,950.00; Matt Construction, Inc. in the amount of $8,850.00; Randy Brummond Construction in the amount of $10,290.68 and Croell, Inc. in the amount of $20,000.00. Discussion followed. Motion by Hackman, Seconded by Carolan to accept the bid from Matt Construction, Inc. in the amount of $8,850.00 to repair the concrete in the parking lot at the jail building due to Brian Tank Masonry did not meet the requirements and specs. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. The County Engineer Dusten Rolando met with the Board to discuss road departmental activities. Topics included: maintenance and service of vehicles; maintenance of gravel roads; work orders in various areas; entrance permits; ditch cleaning permits; day labor, 115th Street, setting box Thursday; sign repairs as needed; spot rocking in various areas; blading gravels all week when possible; reviewing dust control areas; Boyd bridge, substructure pier pile; dirt work abutment, east side; Gilmore Avenue letting today; sheriff parking lot; FY 17 amendment next week; equipment operator advertised. There were two (2) sealed bids for M-2017-2-PCC paving/patching on Gilmore Avenue. Also present were Croell, Inc. representative Jeremy Bahe; Wicks Construction, Inc. representative Brad Wicks, Assistant County Engineer John Murray, County Engineer Dusten Rolando and a member from the media. Vice-Chairman Geerts opened the sealed bids. Bids received from Croell, Inc: Division One in the amount of $315,746.86; Division Two in the amount of $174,174.71 and Wicks Construction, Inc: Division One in the amount of $309,568.85; Division Two in the amount of $168,602.75. The County Engineer’s office reviewed the bids. Motion by Carolan, Seconded by Tilkes to accept the bid from Wicks Construction, Inc. for Division One in the amount of $309,568.85; Division Two in the amount of $168,602.75 as per the recommendation of the County Engineer and authorize Chairman Signature. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. Motion by Tilkes, Seconded by Carolan to set the summer wages for 2017 for summer help. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. Motion by Carolan, Seconded by Hackman to approve permit for Butler County REC to place buried electric line on 260th Street 350 feet east of 1351 260th Street, Nashua, IA in Section 10-T94N-R14W as per the recommendation of the County Engineer. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. A member from the media left at 10:30 AM. Land Use Administrator Staci Schutte met with the Board for the approval of a minor subdivision for the Marcelle Christoph Trust. Motion by Tilkes, Seconded by Hackman to approve Resolution for minor subdivision for the Marcelle Christoph Trust. Roll Call: Ayes: Tilkes, Carolan, Hackman, and Geerts. Absent: Zoll. Motion Carried. Motion Carried. RESOLUTION 05-08-17-21. A RESOLUTION APPROVING THE MINOR SUBDIVISION PLAT OF PARCELS G, H, I AND J IN THE NORTHWEST QUARTER SECTION 23, TOWNSHIP 96 NORTH, RANGE 13 WEST OF THE 5TH P.M., CHICKASAW COUNTY, IOWA. WHEREAS, ON THE 8th DAY of May at a regular meeting by the Board of Supervisors, Chickasaw County, Iowa a minor subdivision plat of Parcels G,H, I and J in the Northwest Quarter of Section 23, Township 96 North, Range 13 West of the 5th P.M., Chickasaw County, Iowa was presented. WHEREAS, the minor subdivision plat of Parcels G,H, I and J in the Northwest Quarter of Section 23, Township 96 North, Range 13 West of the 5th P.M., Chickasaw County, Iowa has been considered and should be approved. NOW, THEREFORE, it is hereby resolved by the Board of Supervisors, Chickasaw County, Iowa that said Minor Subdivision Plat be approved, accepted and the Chairman is hereby directed to certify this Resolution of Approval. Knoll Auditor Sheriff Marty Hemann met with the Board for a departmental update. Also present were County Attorney Pat Wegman, Assistant County Attorney Mark Huegel, and a member from the media. Chief Deputy present at 11:52 AM. Sheriff Hemann informed the Board of a pursuit with Allamakee, Winneshiek and Chickasaw County of which two Chickasaw County Sheriff’s vehicle received minor damage to the vehicles. EMA/911 Director Austen Seely met with the Board for a departmental update. Mr. Seely asked the Board if there were any concerns regarding the Old Vets Building after the Board toured the building last week. Mr. Seely addressed any concern from the Board or to the Board regarding the Medical Examiners Investigator’s position. Mr. Seely informed the Board that he received an informal complaint for the Medical Examiners Investigator’s position. The County Attorney’s office will review the advertisement and job description. Mr. Seely informed the Board that he has been working at the Dispatch center at the Sheriff’s office and hoping to make the space more efficient. Mr. Seely informed the Board that 911 text will be available on May 23rd and that a phone call will always be preferred because only with a phone call can the dispatch services find the location of the phone. Texting only allows dispatchers to know what tower the phone is closest to. Received and filed in the Auditor’s Office MMP Short Form for Annual Updates for Dayton 34 (ID# 68898) in Section 34 of Dayton Township located at 2477 Jasper Avenue, New Hampton, IA 50659.
