COUNTY BOARD MINUTES JULY 17, 2017 The Board convened on Monday, July 17, 2017 at 9:00 A.M. with all members present: Zoll, Tilkes, Carolan, Geerts, and Hackman. The meeting was called to order by Chairman Zoll. Mail was opened and distributed. Also present were Assistant County Attorney Mark Huegel and a member from the media. Motion by Geerts, Seconded by Tilkes to approve agenda for July 17, 2017. Roll Call: All Ayes. Motion Carried. Motion by Geerts, Seconded by Hackman to approve Board Minutes for July 10 & 14, 2017. Roll Call: All Ayes. Motion Carried. Veterans Affairs Commission Chairperson David Boss met with the Board to discuss the salary for the Veterans Affairs Director. Mr. Boss gave the Board an overview from the meetings of July 5, 2017 and the July 13, 2017 meetings. Topics included the interviewing process of the four (4) applicants and the possible hiring of a Veterans Affairs Director, adoption of the Chickasaw County handbook, Veterans Affairs mileage reimbursement rate and claim submission process, State training for the Veterans Affairs Commissioners and Director, etc. David Boss also discussed with the Board comparables of the Veterans Affairs Director salary and status from other surrounding areas. Mr. Boss informed the Board that it was the consensus of the Veterans Affairs Commission that the Veterans Affairs Director starting wage would be $14.50 per hour. This position would be 24 hours per week and the employee would follow the County Handbook. Motion by Carolan, Seconded by Geerts to acknowledge the hiring of Kathy Feuling as the Quality Assurance and Quality Improvement (QA & QI) Coordinator at the hourly rate of $25.00 per hour effective July 5, 2017. Roll Call: All Ayes. Motion Carried. The Board discussed and reviewed the FY 2017-18 County Budget Amendment. Discussion followed. Motion by Hackman, Seconded by Geerts to set the public hearing for August 14, 2017 at 9:00 AM in the Boardroom for FY 2017-2018 County Budget Amendment. Roll Call: All Ayes. Motion Carried. County Engineer Dusten Rolando met with the Board to discuss road departmental activities. Topics included: work orders in various areas; entrance permits, ditch cleaning permits, normal shop activities; reviewed inventory; mowed lawns at shops; durapatcher V56, all week; mowed gravel roads; motorgraders blading gravels; Division 2 rock started; edger rutting in various areas; day labor projects, York Avenue; Kouts box culvert set on Friday; Boyd bridge, poured end sections; removing forms, grade work to start; Gilmore Avenue preconstruction meeting today; midyear meeting in Ames, INRCOG, Waterloo this Thursday, etc. Motion by Hackman, Seconded by Carolan to approve permit for Butler County Rural Electric Cooperative to place underground construction in the county right of way thru 280th Street at 1760 280th Street, Ionia, IA. Treasurer Sue Breitbach met with the Board to review the Suspended Property Tax Certification List for FY 2017-2018. Motion by Geerts, Seconded by Hackman to approve the Suspended Property Tax Certification List for FY 2017-2018 as per recommendation of the Department of Human Services and County Treasurer. Roll Call: All Ayes. Motion Carried. Motion by Geerts, Seconded by Hackman to approve fireworks permit for Jon Nicolaisen. Roll Call: All Ayes. Motion Carried. Assistant County Attorney Mark Huegel and Conservation Director Brian Moore met with the Board to discuss the exchange of real estate with Donald Dean Rowe and Ruth Rowe for the purpose of better defining boundaries. Motion by Carolan, Seconded by Geerts to approve Resolution 07-17-17-38 setting forth the Chickasaw County Board of Supervisors intent to exchange real estate with Donald Dean Rowe and Ruth M. Rowe for the Purpose of better defining boundaries. Roll Call: All Ayes. Motion Carried. RESOLUTION NO. 07-17-17-38 A RESOLUTION SETTING FORTH THE CHICKASAW COUNTY BOARD OF SUPERVISORS INTENT TO EXCHANGE REAL ESTATE WITH DONALD DEAN ROWE AND RUTH M. ROWE FOR THE PURPOSE OF BETTER DEFINING BOUNDARIES. WHEREAS, Chickasaw County owns the following real estate located in Chickasaw County, Iowa, to wit: Commencing at the North Quarter corner of Section 3, Township 94 North, Range 12; thence East 450 feet; thence South 270 feet from center of roadway; thence West 450 feet; thence North 270 feet to the point of beginning, all in said Section 3, Township 94 North, Range 12 West of the 5th P.M., in Chickasaw County, Iowa; and WHEREAS, Donald Dean Rowe AND Ruth M. Rowe are the owners of the following described real estate in Chickasaw County, Iowa, to wit: The Southwest Quarter of the Northeast Quarter and the North Fractional half of the Northeast Quarter except right-of-way of the Chicago and North Western Transportation Company and except commencing at a point 918 feet East of the mid-point on the North line of Section 3, Township 94 North, Range 12, thence South 160 feet from center of roadway, thence East 220 feet, thence North 160 feet to center of roadway, thence West 220 feet to point of beginning, all in Section 3, Township 94 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa EXCEPT Commencing at the North Quarter corner of Section 3, Township 94 North, Range 12; thence East 450 feet; thence South 270 feet from center of roadway; thence West 450 feet; thence North 270 feet to the point of beginning, all in said Section 3, Township 94 North, Range 12 West of the 5th P.M., in Chickasaw County, Iowa and EXCEPT Part of the N½ of the NE¼ of Section 3, Township 94 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa described as commencing at a point 1,138 feet East of the midpoint on the North line of said Section 3, thence South 160 feet from center of roadway, thence West 220 feet, thence North 160 feet, thence West 38 feet, thence South 500 feet, thence East 558 feet, thence North 500 feet, thence West 300 feet to point of beginning (except roads), AND commencing at a point 918 feet East of the midpoint on the North line of Section 3, Township 94 North, Range 12, thence South 160 feet from center of roadway, thence East 220 feet, thence North 160 feet to center of roadway, thence West 220 feet to point of beginning, all in said Section 3, Township 94 North, Range 12 West of the 5th P.M. in Chickasaw County, Iowa; and WHEREAS, Chickasaw County and Donald Dean Rowe and Ruth M. Rowe have jointly created Parcel D in the Northwest Quarter Northwest Quarter of Section 3, Township 95 North, Range 12 West of the 5th P.M. in Chickasaw County, Iowa; and WHEREAS, to complete the exchange previously agreed upon by the parties, Chickasaw County will deed to Donald Dean Rowe and Ruth M. Rowe the property previously described herein as owned by Chickasaw County and Donald Dean Rowe and Ruth M. Rowe will then deed Parcel D in the Northwest Quarter Northwest Quarter of Section 3, Township 95 North, Range 12 West of the 5th P.M. in Chickasaw County, Iowa to Chickasaw County; and WHEREAS, in exchange for the transfer referred to hereinabove, the County will further provide to Donald Dean Rowe and Ruth M. Rowe an easement to maintain an outlet which is seventy (70) feet from the pin in the Southeast Corner of Parcel D. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Chickasaw County Board of Supervisors of Chickasaw County, Iowa: 1. The best interests of Chickasaw County, Iowa, and the citizens thereof require that formal action be taken for the exchange of real estate as set forth hereinabove. 2. That the exchange of said real estate described in paragraph one above is to be completed immediately after a public hearing is held. 3. That a public hearing on the proposed exchange of said property set forth hereinabove shall be held in the boardroom of the Chickasaw County Supervisors at the Chickasaw County Courthouse in New Hampton, Chickasaw County, Iowa, at 9:00 o’clock a.m. on the 7th day of August, 2017. That at said public hearing, any citizen objecting to the exchange of said real estate may appear and make his or her objections known and any citizen wishing to make objections in writing may do so by filing the same with the Chickasaw County Auditor at the Chickasaw County Auditor’s Office in New Hampton, Chickasaw County, Iowa, any time prior to 4:30 o’clock p.m. on the 4th day of August, 2017. 4. That the Chickasaw County Chairman of the Board of Supervisors and the Chickasaw County Auditor be directed to sign all of the appropriate documents to transfer said real estate pursuant to the exchange of real estate. 5. That the legal notice to be published shall be identical to that attached to this Resolution marked Exhibit “A”. Exhibit “A” is incorporated herein as though set forth verbatim. ROWE TO: ALL RESIDENTS OF CHICKASAW COUNTY, IOWA YOU AND EACH OF YOU ARE HEREBY NOTIFIED that at a meeting held on July 17, 2017, the Chickasaw County Board of Supervisors passed Resolution No. 07-17-17-38, giving notice of its intent to consider the exchange of real estate owned by Chickasaw County, Iowa described as follows: Commencing at the North Quarter corner of Section 3, Township 94 North, Range 12; thence East 450 feet; thence South 270 feet from center of roadway; thence West 450 feet; thence North 270 feet to the point of beginning, all in said Section 3, Township 94 North, Range 12 West of the 5th P.M., in Chickasaw County, Iowa with Donald Dean Rowe AND Ruth M.
