COUNTY BOARD MINUTES AUGUST 7, 2017 The Board convened on Monday, August 7, 2017 at 9:00 A.M. with all members present: Zoll, Tilkes, Carolan, Geerts, and Hackman. The meeting was called to order by Chairman Zoll. Mail was opened and distributed. Motion by Geerts, Seconded by Tilkes to approve agenda for August 7, 2017. Roll Call: All Ayes. Motion Carried. Motion by Hackman, Seconded by Carolan to approve Board Minutes for July 31, 2017. Roll Call: All Ayes. Motion Carried. Motion by Hackman, Seconded by Tilkes to open the public hearing at 9:01 AM for the Rowe Property Exchange. Roll Call: All Ayes. Motion Carried. Also present were Conservation Director Brian Moore, Assistant County Attorney Mark Huegel, Donald D. Rowe and Ruth Rowe. No written comments from the public. No verbal comments expressed from the public. Motion by Carolan, Seconded by Geerts to close the public hearing at 9:02 AM. Roll Call: All Ayes. Motion Carried. Motion by Carolan, Seconded by Geerts to approve Resolution 08-07-17-40 exchanging real estate between Chickasaw County, Iowa and Donald Dean Rowe and Ruth M. Rowe. Roll Call: All Ayes. Motion Carried. RESOLUTION NO. 08-07-17-40 A RESOLUTION EXCHANGING REAL ESTATE BETWEEN CHICKASAW COUNTY, IOWA AND DONALD DEAN ROWE AND RUTH M. ROWE. WHEREAS, Chickasaw County owns the following real estate located in Chickasaw County, Iowa, to wit: Commencing at the North Quarter corner of Section 3, Township 94 North, Range 12; thence East 450 feet; thence South 270 feet from center of roadway; thence West 450 feet; thence North 270 feet to the point of beginning, all in said Section 3, Township 94 North, Range 12 West of the 5th P.M., in Chickasaw County, Iowa; And WHEREAS, Donald Dean Rowe AND Ruth M. Rowe are the owners of the following described real estate in Chickasaw County, Iowa, to wit: The Southwest Quarter of the Northeast Quarter and the North Fractional half of the Northeast Quarter except right-of-way of the Chicago and North Western Transportation Company and except commencing at a point 918 feet East of the mid-point on the North line of Section 3, Township 94 North, Range 12, thence South 160 feet from center of roadway, thence East 220 feet, thence North 160 feet to center of roadway, thence West 220 feet to point of beginning, all in Section 3, Township 94 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa EXCEPT Commencing at the North Quarter corner of Section 3, Township 94 North, Range 12; thence East 450 feet; thence South 270 feet from center of roadway; thence West 450 feet; thence North 270 feet to the point of beginning, all in said Section 3, Township 94 North, Range 12 West of the 5th P.M., in Chickasaw County, Iowa and EXCEPT Part of the NĹ of the NEľ of Section 3, Township 94 North, Range 12 West of the 5th P.M., Chickasaw County, Iowa described as commencing at a point 1,138 feet East of the midpoint on the North line of said Section 3, thence South 160 feet from center of roadway, thence West 220 feet, thence North 160 feet, thence West 38 feet, thence South 500 feet, thence East 558 feet, thence North 500 feet, thence West 300 feet to point of beginning (except roads), AND commencing at a point 918 feet East of the midpoint on the North line of Section 3, Township 94 North, Range 12, thence South 160 feet from center of roadway, thence East 220 feet, thence North 160 feet to center of roadway, thence West 220 feet to point of beginning, all in said Section 3, Township 94 North, Range 12 West of the 5th P.M. in Chickasaw County, Iowa; and WHEREAS, Chickasaw County and Donald Dean Rowe and Ruth M. Rowe have jointly created Parcel D in the Fríl Northwest Quarter Northeast Quarter of Section 3, Township 95 North, Range 12 West of the 5th P.M. in Chickasaw County, Iowa; and WHEREAS, to complete the exchange previously agreed upon by the parties, Chickasaw County will deed to Donald Dean Rowe and Ruth M. Rowe the property previously described herein as owned by Chickasaw County and Donald Dean Rowe and Ruth M. Rowe will then deed Parcel D in the Fríl Northwest Quarter Northeast Quarter of Section 3, Township 95 North, Range 12 West of the 5th P.M. in Chickasaw County, Iowa to Chickasaw County; and WHEREAS, in exchange for the transfer referred to hereinabove, the County will further provide to Donald Dean Rowe and Ruth M. Rowe an easement to maintain an outlet which is seventy (70) feet from the pin in the Southeast Corner of Parcel D. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Chickasaw County Board of Supervisors of Chickasaw County, Iowa: 1. The best interests of Chickasaw County, Iowa, and the citizens thereof require that formal action be taken for the exchange of real estate as set forth hereinabove. 2. That at a public hearing held on August 7, 2017, there were no written objections filed nor any oral objections filed or registered with the Chickasaw County Board of Supervisors for the exchange of said property. 3. That a meeting before the Board of Supervisors of Chickasaw County, Iowa, on the 7th day of August, 2017, the Chickasaw County Board of Supervisors agreed to complete the exchange as previously set forth hereinabove. 4. That the Chickasaw County Chairman of the Board of Supervisors and the Chickasaw County Auditor are hereby directed to sign all of the appropriate documents to transfer said real estate pursuant to the terms and conditions set forth hereinabove. DONE THIS 7TH DAY OF AUGUST, 2017, BY THE CHICKASAW COUNTY BOARD OF SUPERVISORS, NEW HAMPTON, CHICKASAW COUNTY, IOWA, AT A MEETING HELD AT 9:00 OíCLOCK A.M. ON SAID DATE. AYES: /ss/ Tim Zoll, Chairman Board of Supervisors, Jacob Hackman, Dan Carolan, David Tilkes, Steve Geerts. NAYS: None ATTEST: /ss/ Joan E. Knoll, Chickasaw County Auditor The protocol for Supervisors putting items on the agenda was discussed. Also present was Assistant County Attorney Mark Huegel. After discussion it was decided to have an agenda item by Board members go through the Chairman and the Chairman would in turn contact the Auditor to have items on the agenda. The Chairman would then advise the remaining Board members of the agenda items that will be discussed. Data Processing manager Doug Welton met with the Board to discuss an agreement with ACES. Discussion followed. Motion by Tilkes, Seconded by Geerts to approve agreement with ACES for a shadowProtect BDR-Data Backup server for the Sheriffís Department at a monthly fee of $249.00 per month and authorize Chairman Signature as per the recommendation of the Data Processing Manager. Roll Call: Ayes: Tilkes, Geerts, Hackman, and Zoll. Nays: Carolan. Motion Carried. Assessor Doug Welton met with the Board met with the Board review 2017 Homestead, Homestead-Disabled Vets, and Military Exemption Applications. Motion by Carolan, Seconded by Hackman to allow the 2017 Homestead Credit Applications, 2 Homestead-Disabled Veterans Credit Applications and Military Exemptions Applications as per the recommendation of the County Assessorís Office. Roll Call: All Ayes. Motion Carried. Motion by Hackman, Seconded by Geerts to approve the Fireworks Permit for Patricia VanAuken. Roll Call: All Ayes. Motion Carried. The Board reviewed the advertisement and job description for part-time scheduled (20 hours/wk) custodian. The Board also reviewed the employment application form from Heartland Insurance Risk Pool and the Current Chickasaw County employment application. Discussion followed. It was the consensus of the Board to use the employment application form from Heartland Insurance Risk Pool. Supervisor Zoll will contact our HR consultant of the Boardís decision. County Engineer Dusten Rolando met with the Board to discuss road departmental activities. Topics included: Flood work continued; hauling rock, pulling rock out of ditches; FEMA representatives came, reviewed areas, work orders; regular shop activities; mowed shop lawns; sign repairs, closures, floods; hard surface mowing started by Nashua; motorgraders, repairing roads; Division II rock started back up; Division 1 started back up today; York Ave, box culvert, day labor, opened up; continue day labor projects; drive sheet pile, eroded bridges, 260th Cheyenne; Boyd bridge, grade work continued; box culvert west of Nashua, Fonterra discounted; etc. Motion by Tilkes, Seconded by Carolan to approve the permit for Windstream Iowa Communications to place buried cable in the county right of way starting at the intersection of Odessa Avenue and 100th Street going east one mile to Pembroke Avenue then south 1300 ft. to 1020 Pembroke Avenue as per the recommendation of the County Engineer. Roll Call: All Ayes. Motion Carried. EMA/911 Director AJ Seely met with the Board for an update on the radio communication tower project. Mr. Seely informed the Board that the fencing project is complete, broadcasting in Analog on SO, EMA channels; working with all cities, fire and police agencies to begin conversion process for radios; internet link at the new tower, signage almost completed; etc. Mr. Seely gave a departmental update. AJ Seely presented to the Board 911 FY 17 Quarterly report and an update on the SBA (Small Business Administration) disaster assistance for storm-damaged counties that includes Black Hawk, Bremer, Buchanan, Butler, Chickasaw, Fayette, and Floyd counties. The Board discussed Northeast Iowa Response Group (NIRG) representatives. In the Board Minutes Dated January 3, 2017 under committee assignments, Regional Hazardous Materials Respond Group: Steve Geerts and Dan Carolan as alternate. Discussion followed. Motion by Hackman, Seconded by Geerts to appoint AJ Seely as the alternate to the NIRG (Northeast Iowa Response Group) representatives. Roll Call: All Ayes. Motion Carried. Custodian Dave Gorman met with the Board to discuss the purchase of a bagger assembly for the lawn tractor. Dave Gorman informed the Board to purchase new bagger assembly for the lawn mower it would cost approximately $1800.00 but if you purchased a used bagger assembly (with 100 hours on the assembly) for the lawn mower it would cost approximately $1300.00. It was the consensus of the Board to authorize the Custodian to purchase a used bagger assembly for the lawn tractor in the amount of $1300.00 from the vendor. The Board discussed the windows and garage at the Heritage Residence and other projects. Dave Gorman informed the Board of a tree removal due to lightening strike at the Chickasaw County Services Building. The Board also discussed the FMC (Floyd-Mitchell-Chickasaw) recycling bin at the Heritage Residence. It was the consensus of the Board to leave the FMC (Floyd-Mitchell-Chickasaw) recycling bin located at the Heritage Residence. The Board discussed the appointment of a liaison member for local update of census address operation (LUCA) for the upcoming census 2020. Discussion followed. Motion by Carolan, Seconded by Tilkes to appoint Jacob Hackman and Tim Zoll as liaison members for local update of census address operation (LUCA) for the upcoming census 2020. Roll Call: All Ayes. Motion Carried. Received and filed in the Auditorís Office Chickasaw County Extension budget for FY 2016-2017. The Board allowed claims. Received and filed in the Auditorís Office MMP Short Form for Annual Updates for Don Kurtenbach-Section 23 (ID #64997) in Section 23 of Utica Township located at 1685 Victoria Way, Lawler, IA 52154. Received and filed in the Auditorís Office MMP Short Form for Annual Updates for Terry and Steve Schulz-Weidler Site (ID#66436) in Section 36 of New Hampton Township located at 2469 Quinlin Avenue, New Hampton, IA 50659. Motion by Carolan, Seconded by Tilkes to adjourn at 11:39 AM. Roll Call: All Ayes.
