COUNTY BOARD MINUTES OCTOBER 2 & 3, 2017 The Board convened on Monday, October 2, 2017 at 9:00 A.M. with all members present: Zoll, Tilkes, Carolan, Geerts, and Hackman. The meeting was called to order by Chairman Zoll. Mail was opened and distributed. Also present were Liz Markham, Paul Greufe, Deb Larsen, Reed Palo, and a member from the media. Motion by Hackman, Seconded by Carolan to approve agenda for October 2 & 3, 2017 with the additional agenda item to Discuss Medical Examiners and Medical Examiner Investigators agreement with possible action. Roll Call: All Ayes. Motion Carried. Motion by Hackman, Seconded by Tilkes to approve Board Minutes for September 25, 2017. Roll Call: All Ayes. Motion Carried. County Engineer Dusten Rolando met with the Board to discuss road departmental activities. Topics included work orders; entrance permits in various areas; repair work, floods, FEMA; start moving dirt pile South of Fredericksburg to be used for shoulder work on V48; normal shop activities; signing removing detour signs; edge rutting; mowing gravels; motorgraders out blading gravels; spot rocking in various areas; FEMA, tree debris removal; paperwork, closing projects out; bridge inspection, underwater, SIIMS input; District 2 meeting, in Kossuth County, etc. Motion by Tilkes, Seconded by Hackman to approve the renewal of the Adopt-A-Highway permit for the Alta Vista Aces 4-h Club to renew their Adopt-A-Highway permit for litter control along B-22 from Alta Vista East 1.5 miles. Roll Call: All Ayes. Motion Carried. Motion by Hackman, Seconded by Tilkes to authorize Chairman Signature on the 28E Agreement for Shared Ownership of Excavator Mounted Pile Driver (Winneshiek, Chickasaw, and Howard Counties). Roll Call: All Ayes. Motion Carried. Assistant County Attorney Mark Huegel met with the Board to discuss the Community Use of County Facilities Policy. Mr. Huegel asked the Board for direction on the Community Use of County Facilities. In 2015, the Veterans by permission asked to use the 1st floor bathrooms. (The elevator was not in use and custodian roped off the main stairs) Mr. Huegel asked the Board whether the Custodian was present during the time of the ceremony and the costs should be reimbursed by the individual organization. Supervisor Zoll will meet with the County Attorney’s Office to review the current Community Use of County Facilities Policy and possibly revise the policy for the Board’s review at a later date. Mr. Huegel also discussed the draft ordinance providing for general requirements regarding the sale of consumer fireworks and use and discharge of consumer fireworks display within the unincorporated areas of Chickasaw County. Supervisors Zoll and Geerts will meet with the County Attorney’s Office to review the draft ordinance for any additional revisions for the Board to review at a later date and continue the process. Supervisor Tilkes update the Board on the job opening at the Northeast Community Action. The Board discussed Medical Examiners and Medical Examiner Investigators. Also present was Liz Markham with Conway-Markham Funeral Home. Ms. Markham talked briefly regarding the e-mail sent to the County Attorney’s Office. Motion by Geerts, Seconded by Hackman to table the discussion of Medical Examiners and Medical Examiner Investigators until a future date. Roll Call: All Ayes. Motion Carried. Liz Markham left at 9:55 AM. County Attorney Patrick Wegman met with the Board to accept his resignation and to discuss replacement options. Also present were Mark Huegel, Sue Breitbach, Cindy Messersmith, Marty Hemann, Reed Palo, Paul Greufe, Deb Larsen, Doug Welton, Jeremy McGrath, Jason Rosol, Jennifer Schwickerath, Pat Wegman, Judge Richard Stochl, Jordan Gansen, Damian Baltes, Scott Egemo, David Skilton, and Steve Lynch. Mr. Wegman submitted his resignation according to Iowa Code 69.4 (4). Motion by Geerts, Seconded by Tilkes to accept the resignation of Patrick Wegman as County Attorney effective October 17, 2017 at 4:30 PM. Roll Call: All Ayes. Motion Carried. County Attorney Patrick Wegman discussed replacement options with the Board. According to Iowa Code 69.8 (3) the Board of Supervisors could make an appointment, unless an election is called as provided in section 69.14A of Code of Iowa. Public comments were received and Ms. Schwickerath presented to the Board a written letter and resume for the position of Chickasaw County Attorney. The County Attorney term expires December 31, 2018. Motion by Geerts, Seconded by Carolan to appoint Jennifer L. Schwickerath as full-time County Attorney effective October 17, 2017 at 4:31 PM. Roll Call: Ayes: Geerts, Carolan, And Tilkes. Nays: Hackman and Zoll. Motion Carried. The Board discussed the settlement check for Case No. 82465. Motion by Geerts, Seconded by Tilkes to authorize the County Auditor to deposit the settlement check in the amount of $1,876.72 in the Health-Flex Insurance Fund (8999). Roll Call: All Ayes. Motion Carried. Motion by Carolan, Seconded by Geerts to adjourn at 10:45 AM. Roll Call: All Ayes. Motion Carried. The Board convened on Tuesday, October 3, 2017 at 9:00 A.M. with all members present: Zoll, Tilkes, Carolan, Geerts, and Hackman. The meeting was called to order by Chairman Zoll. Mail was opened and distributed. Also present was Assistant County Attorney. EMA/911 Director AJ Seely met with the Board to discuss the Chickasaw County Policy for Disclosure of Security Related Information. Motion by Hackman, Seconded by Geerts to adopt the Chickasaw County Policy for Disclosure of Security Related Information. Roll Call: All Ayes. Motion Carried. Jeremy McGrath present at 9:10 AM. Mr. Seely also discussed with the Board the Medical Examiners and Medical Examiners Investigators Agreement. Supervisor Carolan contacted the Medical Examiner Dr. Brinkman and discussed the ordering of supplies. Supervisor Carolan informed the Board that Dr. Brinkman will order the supplies for the medical examiners and submit a bill to the County. Mr. Cook will be contact person for the Medical Examiners Investigators. The Board allowed claims. Received and filed in the Auditor’s Office MMP Short Form for Annual Updates for Don Kurtenbach –Kurppy, LTD (ID#61912) in Section 20 of Stapleton Township located at 2228 Stanley Avenue, Lawler, IA 52154. Motion by Hackman, Seconded by Carolan to adjourn at 9:28 AM. Roll Call: All Ayes.
